Privacy Policy (Amendment)

General Provisions

Cutib US Inc. (hereinafter referred to as the "Company") complies with applicable privacy and data protection laws, including the Act on Promotion of Information and Communications Network Utilization and Information Protection and the Personal Information Protection Act, and establishes and complies with this Privacy Policy in accordance with applicable law to protect the rights and interests of users. This Privacy Policy applies to the Tacu service (hereinafter referred to as the "Service") provided by the Company.

Article 1 (Purpose of Processing Personal Information)

The Company processes personal information for the following purposes. Personal information being processed will not be used for any purpose other than the following purposes, and if the purpose of use changes, the Company will take necessary measures, such as obtaining separate consent, in accordance with the Personal Information Protection Act and other applicable laws.

Membership Registration and Management: confirming intention to register, user identification and authentication, maintaining and managing membership status, preventing unauthorized use, notices and notifications, and handling grievances

Provision of Services and Performance of Contracts: providing paid and free Services, managing subscription plans and credits, providing content (including AI-generated content), sending contracts, bills, and tax invoices (where applicable), providing customized Services, and processing and settling payments (including international payments)

Provision of AI Features: processing Input Data provided by users to generate and provide AI Outputs

Handling Grievances: verifying the identity of complainants, confirming complaints, contacting and notifying users for fact-finding, and notifying users of the processing results

Service Improvement and Development: analyzing usage statistics, improving errors, developing new features, improving UX, and improving AI model performance (processed in a form that does not identify individuals and subject to an explicit opt-out right)

Marketing and Advertising (with optional consent): developing new Services and customized Services, providing events and promotional information (by email and in-Service notifications), interest-based advertising (including cookies), and identifying access frequency/statistics (separate consent required)

Compliance with Legal Obligations: fulfilling statutory retention obligations and responding to lawful requests from investigative agencies and other competent authorities

Article 2 (Items of Personal Information Processed)

Membership Registration and Management

Required items: email address, password, name (or nickname), account (ID)

Optional items: profile photo, affiliation (company/team name), occupation/role, and other information voluntarily provided by the user

When Using Paid Services

Payment information: tokenized/encrypted information necessary for payment processing, such as partial card number and expiration date, PayPal account information, etc. (actual payment information is not stored by the Company and is processed by third-party payment processors)

Billing information: name, address (including country), contact information (for tax invoice/invoice issuance)

When Using AI Features

Input Data: personal information included in text (loglines, prompts, etc.) and uploaded image/video/audio files

AI Output Data: personal information included in images, videos, audio, text, and other materials generated within the Service

Information Automatically Collected During Use of the Service

IP address, cookies, browser type and OS, usage history (login, page visits, feature usage, AI tasks, credit consumption), device information (Device ID), and access location (country level)

Customer Support

Inquiry details, email address, phone number, and other information provided by the user

Marketing/Survey Participation (optional)

Survey responses, interest information, and other related information

Collection Methods

Website (registration and Service use), written forms, telephone/fax, customer center inquiries, event participation, provision by partners (where applicable), and automatic collection through tools for collecting generated information

The Services provided by the Company are not directed to residents of the European Union (EU), European Economic Area (EEA), or the United Kingdom, and the Company does not intentionally collect or process personal information of residents of those regions.

Article 3 (Processing and Retention Period of Personal Information)

The Company processes and retains personal information within the retention and use period prescribed by law or the period for which consent has been obtained. The main retention periods are as follows.

Member information: until membership withdrawal (including exceptions such as ongoing investigations/inspections, remaining claims or obligations, and retention for one year after withdrawal for the purpose of preventing unauthorized use and resolving disputes)

Records related to Service provision and contract performance (Article 6 of the Enforcement Decree of the Act on Consumer Protection in Electronic Commerce, etc.): contracts/subscription withdrawals for 5 years, payment/supply records for 5 years, complaints/disputes for 3 years, and display/advertising records for 6 months

AI Input Data and AI Output Data:

For Service provision/access purposes: retained until project/content deletion or membership withdrawal and then destroyed (where immediate destruction is technically difficult, access may be blocked and the data destroyed sequentially)

For Service improvement/AI training purposes (on the premise that data is processed so that individuals cannot be identified): retained and used for a period pursuant to the Company's internal policy based on the perpetual license under Article 14(1) of the Terms of Use

Private Input Data and AI Outputs of Enterprise Members are not used for training the Company's general-purpose AI models or third-party AI models unless otherwise provided in a separate agreement or with explicit consent

Communications confirmation data (Article 15-2 of the Protection of Communications Secrets Act): logs and access location tracking data for 3 months

Information for which marketing use consent has been given: until withdrawal of consent or membership withdrawal

Other statutory obligations: until the period prescribed by the applicable law

Article 4 (Provision of Personal Information to Third Parties)

In principle, the Company does not provide personal information to external third parties without the user's consent. However, exceptions may apply where the user has given prior consent or where there is a lawful request from investigative agencies or other competent authorities based on applicable law.

Article 5 (Entrustment of Personal Information Processing)

The Company may entrust personal information processing to domestic and overseas service providers for smooth handling of personal information-related operations, and will enter into entrustment agreements and manage and supervise the entrusted service providers in accordance with applicable law. Where such entrustment involves cross-border transfer, the Company complies with the applicable legal requirements.

Article 6 (Destruction Procedure and Method for Personal Information)

The Company destroys personal information without delay when it becomes unnecessary, such as upon expiration of the retention period or achievement of the processing purpose.

Where personal information must be preserved under other laws, the Company preserves the information by transferring it to a separate database or storing it in a different location.

Electronic files are destroyed by methods that make recovery impossible (e.g., low-level formatting), and paper documents are shredded or incinerated.

Article 7 (Rights and Obligations of Data Subjects and How to Exercise Them)

Data subjects may request access, transmission, correction, deletion, suspension of processing, withdrawal of consent, and other rights regarding their personal information, and may exercise such rights in writing, by email, or through functions within the Service.

Article 8 (Installation, Operation, and Refusal of Cookies)

The Company collects and uses cookies in the course of using the Service to provide users with optimized customized Services and benefits, online personalized advertising, etc., and may use similar technologies such as web beacons and pixels.

Users may block or allow online personalized advertising in bulk by changing cookie settings in their web browsers. However, changing cookie settings may affect the use of some Service features, such as automatic website login.

Article 9 (Measures to Ensure Security)

Administrative measures: establishing and implementing an internal management plan, minimizing and training personnel handling personal information, and conducting self-audits

Technical measures: access authorization and control, encryption, security programs, retention of access logs, and measures to prevent alteration or tampering

Physical measures: access control for computer rooms and data storage rooms

Article 11 (Changes to the Privacy Policy)

Changes will be announced from 7 days before the effective date. Important changes will be announced 30 days in advance, and the Company may obtain consent again where necessary.

Article 12 (Cross-Border Transfer)

For the purpose of providing the Service and performing contracts, the Company may process collected personal information through global infrastructure (such as AWS) in the United States and other countries, and will take measures to ensure security in accordance with applicable laws. In particular, for users residing in Korea, data may be transferred to and stored in the United States and other countries when using the Service.

Article 13 (Language)

This Privacy Policy is prepared in Korean. Any translation provided in another language is for convenience only, and if there is any inconsistency or discrepancy between the Korean version and any translated version, the Korean version shall prevail.

Article 14 (Remedies for Infringement of Rights)

The Company makes its best efforts to handle users' inquiries and complaints regarding personal information. For primary complaints and exercises of rights, please contact the Company's Personal Information Protection Officer or responsible department (support@cutib.com).

Cutib US Inc.(이하 "회사")은 정보통신망 이용촉진 및 정보보호 등에 관한 법률, 개인정보 보호법 등 관련 법령상의 개인정보보호 규정을 준수하며, 관련 법령에 의거한 개인정보처리방침을 정하여 이용자 권익 보호에 최선을 다하고 있습니다. 본 개인정보처리방침은 회사가 제공하는 Tacu 서비스(이하 "서비스")에 적용됩니다.

제1조 (개인정보의 처리 목적)

회사는 다음의 목적을 위하여 개인정보를 처리합니다. 처리하고 있는 개인정보는 다음의 목적 이외의 용도로는 이용되지 않으며, 이용 목적이 변경되는 경우에는 개인정보 보호법 등 관련 법령에 따라 별도의 동의를 받는 등 필요한 조치를 이행합니다.

회원 가입 및 관리: 회원 가입 의사 확인, 본인 식별·인증, 회원자격 유지·관리, 부정이용 방지, 고지·통지, 고충 처리

서비스 제공 및 계약 이행: 유료/무료 서비스 제공, 구독 플랜/크레딧 관리, 콘텐츠(AI 생성물 포함) 제공, 계약서·청구서·세금계산서 발송(해당 시), 맞춤 서비스 제공, 요금 결제·정산(국제 결제 포함)

AI 기능 제공: 이용자가 제공한 입력(Input) 데이터를 처리하여 AI 생성물(AI Output) 생성 및 제공

고충 처리: 민원인의 신원 확인, 민원사항 확인, 사실조사를 위한 연락·통지, 처리 결과 통보

서비스 개선 및 개발: 이용 통계 분석, 오류 개선, 신규 기능 개발, UX 향상, AI 모델 성능 개선(개인 식별 불가능 형태 처리 및 명시적 거부권 행사 가능)

제3조 (개인정보의 처리 및 보유 기간)

서비스 개선/AI 학습 목적(개인 식별 불가능 처리 전제): 이용약관 제14조 1항의 영구 라이선스에 근거하여 내부 방침에 따른 기간 보유·이용

기업회원의 비공개 입력 데이터 및 AI 생성물은 별도 계약 또는 명시적 동의가 없는 한 회사의 범용 AI 모델 또는 제3자 AI 모델 학습 목적으로 사용하지 않음

제4조 (개인정보의 제3자 제공)

회사는 원칙적으로 이용자의 동의 없이 개인정보를 외부에 제공하지 않습니다. 다만, 사전 동의가 있거나 법령에 근거한 수사기관 등의 적법한 요청이 있는 경우 예외로 합니다.

제5조 (개인정보 처리업무의 위탁)

회사는 원활한 개인정보 업무처리를 위해 개인정보 처리업무를 국내외 업체에 위탁할 수 있으며, 위탁 계약 및 관리·감독을 관련 법령에 따라 수행합니다. 국외 이전을 수반하는 경우 적법 요건을 준수합니다.

제6조 (개인정보의 파기절차 및 파기방법)

보유 기간 경과, 목적 달성 등 불필요해진 경우 지체없이 파기합니다.

다른 법령에 따라 보존이 필요한 경우 별도 DB로 옮기거나 보관 장소를 달리하여 보존합니다.

전자적 파일은 복구 불가능한 방법으로 파기(예: 로우레벨포맷), 종이 문서는 분쇄/소각합니다.

제7조 (정보주체의 권리·의무 및 행사방법)

정보주체는 열람, 전송, 정정, 삭제, 처리정지, 동의 철회 등을 요구할 수 있으며, 서면/전자우편/서비스 내 기능 등을 통해 행사할 수 있습니다.

제8조 (쿠키의 설치·운영 및 거부)

회사는 서비스 이용과정에서 이용자에게 최적화된 맞춤형 서비스 및 혜택, 온라인 맞춤형 광고 등을 제공하기 위해서 쿠키를 수집 및 이용하며, 웹 비콘/픽셀 등 유사 기술을 사용할 수 있습니다.

이용자는 웹브라우저의 쿠키 설정 변경 등을 통해 온라인 맞춤형 광고를 일괄적으로 차단, 허용할 수 있습니다. 다만, 쿠키 설정 변경은 웹사이트 자동로그인 등 일부서비스의 이용에 영향을 미칠 수 있습니다.

제14조 (권익침해 구제방법)

회사는 이용자의 개인정보 관련 문의 및 불만을 처리하기 위해 최선을 다하고 있습니다. 일차적인 민원 및 권리 행사는 회사의 개인정보 보호책임자 또는 담당부서(support@cutib.com)로 연락해 주시기 바랍니다.
